In Colorado law, there are two legal grounds for a bad faith insurance claim. The victim has two options for submitting a bad faith insurance claim: a common-law or statutory one. You, the victim, can file a claim for both common-law and statutory grounds.

Colorado's Goodson v. American Standard Insurance Co. (89 P.3d 409, 414, Colorado 2014), explains how bad faith insurance claims are governed by common law. A common-law case is won when the victim proves that the insurer refused to pay or delayed payment. The insurance company must have acted unreasonably or with a reckless disregard for the truth. The case is decided objectively by the court using all evidence and facts available to it at the time.

Colorado law 10-3-1115 is the statutory basis of a bad-faith legal claim. This law states that insurance companies cannot delay or deny benefits payments. It also states that a denial or delay is a violation if made with an unreasonable basis for the action.

Common law actions require an involuntary or reckless disregard of rights, but Colorado's statutory law only requires an unreasonable denial.
